Allahabad HC Rejects Homebuyers’ Challenge to Noida’s Ekanam Project

Noida: The Allahabad High Court has dismissed a petition filed by a group of homebuyers challenging the additional Floor Area Ratio (FAR) granted to Great Value Realty for its luxury residential project, Ekanam, in Sector 107, Noida. In its July 1 order, the court ruled that the approvals were granted after following the prescribed legal process and were backed by the consent of a majority of flat owners, clearing the way for the project to move forward.
The dispute relates to a 20-acre land parcel leased by the Noida Authority to Great Value Realty between 2010 and 2015. The approved 2017 layout allocated 16 acres for the Sharanam residential project, while the remaining 4 acres were reserved for future development. After the Sharanam project was handed over, some residents raised concerns over amenities and objected to plans for an additional luxury tower.
Following a verification exercise, the Noida Authority found that 978 out of 1,440 homebuyers had supported the proposal. Based on this, it approved an additional FAR of 0.6 in December 2024, followed by a revised building plan in June 2025.

The Apartment Owners Association argued that any additional FAR should be used to improve common facilities instead of constructing a separate premium tower. It also claimed the move violated provisions of the UP Apartment Act, which protects apartment owners’ undivided share in common areas.
However, the High Court observed that the land had always been earmarked for future development and that there was no encroachment on parks, open spaces, or common amenities. Justice Arun Kumar noted that the written consent given by a substantial majority of buyers remained legally valid and could not be overridden by the association’s challenge. Great Value Realty Director Payas Agarwal said the company would now focus entirely on completing the project.
The judgment provides legal clarity for both developers and homebuyers on the use of additional FAR in planned residential projects. It also reinforces that approvals supported by due process and majority consent are likely to receive judicial backing. For buyers of the upcoming Ekanam project, the ruling removes a major legal hurdle and allows construction to continue without uncertainty.
Great Value Realty will continue construction of Ekanam, which will feature 280 luxury 3 and 4 BHK apartments ranging from 3,525 sq ft to 5,525 sq ft. The project began construction in 2025 and is scheduled for possession in 2030. With the court dismissing the petition, the developer is expected to proceed with the project as approved by the Noida Authority.
