UP Govt. Reduces Rent Agreement Registration Cost

Uttar Pradesh has made rental agreement registration more affordable by permanently reducing documentation costs, particularly for agreements involving annual rents of up to ₹10 lakh.

Uttar Pradesh: The Uttar Pradesh government has permanently reduced the registration cost for rental agreements, providing financial relief to landlords and tenants across the state. The decision was taken at a cabinet meeting chaired by Chief Minister Yogi Adityanath on Tuesday.

Under the revised structure, registration for a rental agreement of up to one year and an annual rent of up to ₹2 lakh will now cost ₹2,000, compared with ₹10,000 earlier.

The move is part of the government’s effort to encourage formal registration of tenancy agreements and implement the Uttar Pradesh Urban Premises Tenancy Regulation Act, 2021 more effectively. The revised charges also provide substantial relief on longer rental agreements, with concessions available for properties where the average annual rent does not exceed ₹10 lakh.

Under the new fee structure, a one-year agreement with an average annual rent of up to ₹2 lakh will require ₹1,000 in stamp duty and ₹1,000 as the registration fee. For agreements lasting up to 10 years, the maximum amount under the revised concessionary structure is ₹26,000 when the average annual rent is between ₹6 lakh and ₹10 lakh.

The revised documentation costs are:

The concession applies to rental agreements falling within the specified rent limits. Properties with an average annual rent above ₹10 lakh will not receive the same exemption, and applicable stamp duty and registration charges will continue under the existing framework for the amount beyond the concession limit.

Ravindra Jaiswal, Minister of State (Independent Charge) for Stamps and Registration, said the decision is intended to support implementation of tenancy regulations while reducing the financial burden associated with registration.

Under the tenancy rules, rental agreements for periods exceeding one year are required to be registered. Failure to properly pay applicable stamp duty can lead to proceedings for recovery of the outstanding duty, along with other consequences under the law.

The government had initially introduced the concession for six months from November 19 last year. Officials said the response during that period was encouraging, leading to the decision to make the reduced rates permanent.

The cost of registering a rental agreement has historically discouraged some landlords and tenants from completing formal registration. According to the government, the earlier charges could amount to more than 4% of the average annual rent in certain cases.

For shorter tenancies, many landlords and tenants instead relied on agreements executed on relatively low-value stamp paper. While such arrangements may appear cheaper initially, a properly documented and registered agreement can provide clearer evidence of the terms agreed between both parties and can be useful when tenancy-related disputes arise.

The government said the earlier six-month concession resulted in an estimated revenue loss of around ₹8.31 crore. Consequently, the permanent scheme has been structured with revised limits, replacing the earlier concession range of ₹1,000 to ₹20,000 with a revised range of ₹2,000 to ₹26,000.

Landlords and tenants entering into longer-term rental arrangements should check the applicable stamp duty and registration requirements before executing the agreement. The actual amount payable will depend on factors such as the agreement period and average annual rent.

Those entering into a rental arrangement should also ensure that the agreement clearly records important terms, including rent, security deposit, tenancy period, maintenance responsibilities, notice period and other mutually agreed conditions.

The reduced registration charges could make formal rental documentation more accessible while helping both parties maintain stronger legal records of their tenancy arrangements.
