AOA Can Disconnect Electricity Over Unpaid Maintenance

The court has cancelled notices issued by Paschimanchal Vidyut Vitran Nigam Limited and declined to intervene in the dispute between the RG Residency AOA and residents over maintenance payments.

Greater Noida: The Allahabad High Court has delivered an important ruling in a dispute involving RG Residency and residents who allegedly failed to pay maintenance charges. The court’s decision addresses the use of electricity disconnection as a measure against residents who continue to use society facilities without paying maintenance dues.

According to the case details reported from RG Residency, electricity is supplied to the society through a single-point connection. The main electricity supply is received by the society and then distributed among individual flats. Electricity consumption and maintenance charges are collected through a consolidated billing system.

The Residents’ Association alleged that some residents were paying their electricity dues but withholding maintenance payments. Despite using common services and facilities, these residents were allegedly not contributing toward the maintenance of the society.

Following the dispute, the association disconnected the electricity connections of some residents who had not been paying maintenance charges. The affected residents approached the electricity department, following which the utility issued notices to the association and directed that the electricity supply be restored.

The dispute subsequently reached the Allahabad High Court. The RG Residency Apartment Owners Association challenged notices issued by the electricity distribution company, including those dated April 8 and April 13.

The matter was heard by a division bench comprising Justice Arindam Sinha and Justice Satyavar Singh. The court ultimately cancelled the notices issued by the electricity distribution company.

The ruling provides significant relief to the AOA in the matter. The report states that the court made it clear that recovery of maintenance dues would not be made from the petitioner association through the electricity company.

The association had argued that residents should not be allowed to avoid maintenance payments while continuing to use essential society services such as security, cleanliness, lifts, common areas and electricity-related infrastructure.

AOA representatives said the judgment strengthens the society’s position against residents who pay only their electricity bills but do not pay the maintenance charges required to operate the residential complex.

The RG Residency case could become a significant reference point for apartment associations across Noida, Greater Noida and Ghaziabad, particularly societies operating under a single-point electricity connection.

Such societies often face disputes when residents pay electricity consumption charges but withhold maintenance payments. The case highlights the legal complications that can arise when electricity supply and maintenance collection are managed together.

The judgment is therefore likely to attract attention from apartment owners’ associations dealing with similar maintenance-related disputes.
