Noida Authority Demolishes Illegal commercial complex in Hazipur, Sector 104

• Demolition carried out on around 7,950 sq m of land in Sector 104.
• The property was reportedly being developed as a five-storey commercial complex.
• Action followed dismissal of an ex-parte stay order against the Noida Authority.

Noida: The Noida Authority has demolished illegal commercial complex spread across approximately 7,950 square metres in Hazipur, Sector 104, following the removal of a legal hurdle that had prevented action on the disputed property. The demolition was carried out on Friday as part of the authority’s drive against unauthorised construction and alleged land encroachment.

The property is located on Khasra No. 412, which the authority says was acquired in 2002. Despite the acquisition, construction of a commercial complex reportedly began on the site in 2023. Nishyam Buildcon Private Limited and Himshree Himalaya Buildtech Private Limited were associated with the construction, which the authority considered unauthorised.

The legal dispute had delayed enforcement action for nearly three years. On April 12, 2023, an ex-parte stay order had been issued against the authority, preventing it from proceeding with demolition. The Additional Civil Judge, Senior Division, Gautam Buddh Nagar, has now dismissed that stay, allowing the authority to move ahead with action on the property.

The demolition operation was conducted under the supervision of senior Noida Authority officials, including OSDs Harshita Tiwari and Indu Prakash Singh, General Manager (Civil) Ashok Kumar Arora and Senior Manager of Work Circle-8 Rohit Kumar.

According to OSD Indu Prakash Singh, Noida Authority CEO Krishna Karunesh has directed officials to take firm action to remove illegal encroachments from authority-owned land. Police personnel were also deployed during the operation. Some individuals reportedly arrived at the site to oppose the demolition but were brought under control without the situation escalating.

The Sector 104 property had previously been at the centre of a serious confrontation. During an earlier attempt to stop construction, officials from Work Circle-8 were allegedly surrounded, and manager Deepak Kumar was reportedly dragged into the building. An attempt was allegedly made to set him on fire using diesel. Following the incident, the authority filed an FIR against individuals it identified as part of the alleged land mafia.

The demolition is important because it demonstrates the Noida Authority’s renewed ability to act on land where legal proceedings had previously restricted enforcement. The disputed plot had remained tied up in litigation, while construction continued on land that the authority maintains was acquired for public purposes.

The case also highlights the challenges authorities face in dealing with unauthorised development on acquired land. Clearing legal disputes before demolition can significantly delay enforcement, particularly when substantial commercial structures have already been constructed.

With the stay order dismissed and the construction demolished, the Noida Authority is expected to proceed with further administrative and legal measures concerning the disputed land. Officials are likely to assess the remaining encroachment, establish possession and take steps required to protect the authority’s land from further unauthorised development.

The Hazipur case could also become an important example of Noida’s wider crackdown on illegal construction and encroachment, particularly on land that has already been acquired by the authority.
