Express Greens Gurugram Buyers Share 17-Year Struggle: “We Paid in 2009, Still Homeless”

Homebuyers accuse HSIIDC of delays despite Supreme Court intervention; families say savings exhausted, retirement plans shattered

Manesar, Gurugram: A long-pending housing dispute linked to the Express Greens residential project in Sector M1, Manesar, Gurugram, has once again drawn attention after affected homebuyers approached government authorities and sought media intervention over alleged delays in project completion.

Several homebuyers claim they have been waiting for possession of their homes for over 17 years despite making substantial payments to the developer in 2009. The matter relates specifically to Independent Floors and Town Houses within the Express Greens township, a project originally developed by DLF Home Builders.

According to documents shared by affected buyers, the project was initially scheduled for possession in 2012. However, construction delays, legal disputes, and subsequent transfer of the project to Haryana State Industrial & Infrastructure Development Corporation (HSIIDC) have left many buyers without possession till date.

The dispute traces back to Civil Appeal No. 8788 of 2015 titled “Rameshware & Others vs State of Haryana & Others.” Homebuyers state that the Supreme Court ruled in favour of affected buyers in 2018 and later clarified its order in 2022.

Following the court proceedings, the project was transferred from DLF to HSIIDC for completion and delivery to buyers under the original terms and conditions agreed between buyers and the developer.

However, homebuyers allege that despite the passage of several years after the Supreme Court’s intervention, Independent Floors and Town Houses in the project remain incomplete.

A letter dated June 12, 2024, issued by HSIIDC and shared by homebuyers, reportedly offered affected buyers two options:

  1. Complete the remaining construction work themselves on an “as is where is” basis.
  2. Accept a refund along with 6% annual interest.

Homebuyers have objected to both options, claiming they are financially exhausted after already paying substantial amounts nearly 17 years ago. Many buyers argue that a refund with 6% interest would not enable them to purchase similar property in Gurugram at current market prices.

Several buyers also claim they have continued paying rent for years while awaiting possession.

Affected residents say the prolonged delay has caused severe emotional, financial, and mental stress. Some buyers claim they invested their life savings or took bank loans to purchase these homes.

According to representations sent to authorities, several families are now approaching retirement age while still awaiting possession. Buyers have also alleged that some allottees passed away during the prolonged legal and construction delays.

One of the affected buyers, Ankesh Surinder, stated in his representation to authorities that the incomplete structures have remained standing for years without final completion work.

The buyers further allege that more than 800 families already reside in completed tower sections of the township, while Independent Floor and Town House buyers continue to wait.

Documents reviewed by H4ENEWS indicate that certain homebuyers are part of contempt petitions currently pending before the Hon’ble Supreme Court, including CONMT.PET.(C) No. 1013 of 2023 and related matters.

The buyers allege that the project has not been completed in the spirit of the Supreme Court’s directions and have requested judicial intervention for a time-bound resolution.

The matter has also been escalated to multiple government offices, including:

  • Prime Minister’s Office
  • Ministry of Housing and Urban Affairs
  • President’s Secretariat
  • Haryana Government authorities
  • Haryana RERA

Email communications reviewed by H4ENEWS show that the grievance was forwarded through official government channels for examination and appropriate action.

Homebuyers Demand Completion Instead of Refund

Homebuyers have demanded that HSIIDC complete the pending construction and hand over possession under the original agreement terms instead of offering refunds or asking buyers to fund construction independently.

The buyers are also seeking compensation for prolonged delays, rental expenses, legal costs, and mental hardship suffered over the years.

As the matter is currently pending before the Supreme Court and connected legal proceedings are ongoing, the allegations made by homebuyers have not yet been judicially adjudicated in the ongoing contempt proceedings.

The case continues to highlight the larger issue of delayed housing projects and the prolonged struggles faced by homebuyers in stalled real estate developments across India.
