Gurugram Builders Cannot Cut Power Over Unpaid Maintenance Dues, Says Haryana CM

Gurugram: Haryana Chief Minister Nayab Singh Saini has made it clear that builders in Gurugram cannot disconnect electricity connections to recover unpaid maintenance charges from residents. The announcement came during a District Public Relations and Grievance Redressal Committee meeting after residents raised complaints against a private developer in Sector 83.

The move is significant as it reinforces the rights of homeowners and protects access to electricity, an essential service, during maintenance-related disputes.

The issue came to light after the Residents’ Welfare Association (RWA) of a housing society in Sector 83 alleged that the builder had repeatedly disconnected electricity connections to pressure residents into paying disputed maintenance dues. Responding to the complaints, the Chief Minister directed officials to take immediate action against any developer violating electricity regulations.

He also reminded authorities that the Haryana Electricity Regulatory Commission (HERC) already prohibits developers and electricity franchisees from disconnecting power over unpaid maintenance charges, sinking fund contributions, facility management fees, or other non-electricity dues. Electricity bills must separately mention power consumption charges and maintenance-related charges so that residents are not penalised for unrelated disputes.

Chief Minister Nayab Singh Saini said electricity is an essential service and cannot be used as a tool to force residents into clearing disputed maintenance bills. He instructed officials to ensure strict enforcement of HERC regulations and warned that builders found violating these rules would face legal action. The Chief Minister also directed government departments to act swiftly on complaints instead of allowing such disputes to continue.

The directive is expected to provide significant relief to thousands of residents living in private housing societies across Gurugram, where complaints of electricity disconnections over maintenance disputes have surfaced repeatedly. It also strengthens consumer rights by ensuring that residents who have paid their electricity consumption charges cannot lose power due to disagreements over maintenance payments.

During the meeting, the Chief Minister also addressed other civic concerns. He ordered municipal authorities to clear illegally dumped construction and demolition waste in Sector 102 within 30 days and recover the entire cleanup cost, along with penalties, from the responsible developers.

Officials have been instructed to take strict legal action against builders violating electricity regulations and ensure full compliance with HERC rules. The Chief Minister also warned government officials that negligence or delays in resolving public complaints received through the CM Window portal would invite disciplinary action. Authorities are now expected to closely monitor developers to prevent future instances of illegal power disconnections.
