Edenwood Towers Faridabad RWA Moves HRERA Over Alleged Sale of Common Visitor Parking

Faridabad: The Edenwood Residents Welfare Association (RWA), representing residents and allottees of Edenwood Towers in Charmwood Village, Sector 39, Faridabad, has approached the Haryana Real Estate Regulatory Authority (HRERA), Panchkula, over the alleged sale or allotment of common stilt and visitor parking spaces as private property.
The complaint, filed against Eros Group (Ajay Enterprises Private Limited), concerns the Edenwood Towers project registered with HRERA under Registration No. HRERA-PKL-FBD-92-2019. The RWA claims that some parking spaces identified as visitor parking in the sanctioned layout were allegedly allotted to individual unit holders instead of being retained for common use.
According to the association, the disputed spaces include parking areas in Tower 1 and Tower 2 that were shown as visitor parking in the approved plans. The RWA alleges that these spaces were subsequently treated as saleable inventory and allotted to individual owners.
The association has based its complaint, among other things, on the legal position that common parking areas cannot ordinarily be sold as independent units. It has referred to the Supreme Court’s ruling in Nahalchand Laloochand Pvt. Ltd. v. Panchali Co-operative Housing Society Ltd., concerning the status of stilt and open parking areas, as well as provisions under the Haryana Real Estate (Regulation and Development) Rules, 2017.
The RWA’s position is that converting designated visitor parking into privately allotted spaces reduces the parking available for the wider community and changes the intended use of an area meant for residents and their visitors.
In its complaint, the association has sought cancellation of the allegedly improper parking allotments and restoration of the disputed areas to their designated common use.
It has also requested complete disclosure of parking allotments, including details of the spaces allotted to individual unit holders and the consideration, if any, received against those allotments. The association is seeking these details through an affidavit as part of the proceedings.
The dispute could have a direct bearing on parking availability within the Edenwood Towers community. If the allegations are established before the authority, the matter could lead to changes in the status or use of the disputed parking spaces.
For residents, the issue is significant because visitor parking is intended to serve the wider community rather than individual households. Any change in the availability or allocation of such spaces can affect parking management and access for residents and their guests.
At this stage, however, the allegations made by the RWA are part of an ongoing regulatory proceeding and have not been finally adjudicated by HRERA.
The first hearing in the matter before HRERA, Panchkula, is scheduled for September 2026. The authority will consider the complaint and the responses of the parties before determining the matter.
The proceedings are expected to bring greater clarity on the status of the disputed parking spaces, the basis of their alleged allotment and whether any corrective action is required.
The Edenwood Residents Welfare Association is the registered body representing the allottees and residents of Edenwood Towers, Faridabad.
