UP Govt Allows Builder to Expand Sector 107 Project, Noida

In a major relief to Great Value Projects India Limited, the Uttar Pradesh government has dismissed a plea filed by the Great Value Sharanam Apartment Owners Association (AOA), thereby permitting the real estate developer to move forward with new construction within its housing project in Sector 107, Noida.

The AOA had earlier contested the Noida Authority’s orders issued on December 19, 2024, and June 11, 2025, alleging that the approvals for additional Floor Area Ratio (FAR)—which allows developers to construct additional built-up area—were granted unlawfully and without proper consent from existing residents.

However, in its latest decision, the state’s Infrastructure and Industrial Development Department upheld the Authority’s actions, affirming that the approvals complied with legal and procedural norms under the UP Industrial Area Development Act, 1976.

In an order dated October 27, 2025, Alok Kumar, Additional Chief Secretary, Industrial Development Department, rejected the AOA’s revision petition, declaring it “not maintainable” under the provisions of the UP Apartment Act, 2010.

The order further stated that the Noida Authority had followed due process while granting the additional FAR. It highlighted that consent for purchasing the extra FAR was obtained from 1,165 flat owners, while 429 residents had raised objections. Following public notices and a review of all responses, the Authority approved the revised layout plan.

Noida Authority and Developer Respond

Vandana Tripathi, Additional CEO of the Noida Authority, confirmed that the government’s decision allows the builder to proceed as per rules and in line with the approved plan.

“The Uttar Pradesh government has dismissed the objections raised by homebuyers and allowed the realty firm to carry on with its development plans. We will take appropriate steps in accordance with the directive,” Tripathi said.

Reacting to the verdict, Great Value Realty stated that the order validates the legality of the approval process and the company’s adherence to all regulatory protocols.

“This ruling upholds the due process followed by the Noida Authority in granting additional FAR,” a company spokesperson said. “We remain committed to developing sustainable and high-quality residential spaces that meet modern urban needs.”

What the Order Means for Residents and the Project

With the rejection of the AOA’s plea, Great Value Projects India Ltd now has a clear go-ahead to begin construction of new residential towers on the vacant land parcels within the Sector 107 housing complex. The move effectively ends a months-long legal dispute between residents and the developer over land utilization and construction rights.

While the AOA had argued that the additional FAR altered collective property rights of existing homeowners and required majority consent, the state government concluded that the Authority’s approval process met all statutory obligations, including public notice and resident participation.

Background of the Dispute

The controversy began after the Noida Authority approved an increase in the project’s FAR, allowing Great Value to add new residential structures within the existing complex. Homeowners alleged that the change would strain the project’s infrastructure, increase population density, and impact open spaces promised at the time of purchase.

Despite these concerns, the Authority maintained that the decision was in line with development control regulations and zoning norms, emphasizing that such modifications are permissible when adequate consent is secured and technical feasibility is ensured.

With the government’s backing, Great Value Realty is expected to commence work on the next phase of residential construction, as per the revised layout approved by the Noida Authority. The company claims the upcoming development will enhance the project’s infrastructure while maintaining sustainability standards.

The decision also sets a precedent for similar cases across the Noida-Greater Noida region, where several resident associations have objected to developers seeking additional FAR for expansion.

The UP government’s move marks a significant win for Great Value Realty and could accelerate ongoing construction activity in Sector 107. However, it also reignites the ongoing debate between homebuyers’ rights and developers’ expansion ambitions in Noida’s rapidly evolving real estate landscape.
