Sobha Rivana & Max Estate 105 Fined Rs 5 Lakh by UP-RERA

UP-RERA penalises developers of Estate 105, Sobha Rivana, and Avikalp Estate for promoting and selling unregistered projects, reinforcing strict compliance rules under the Real Estate Act across Uttar Pradesh.

Uttar Pradesh Real Estate Regulatory Authority (UP-RERA) has taken strict action against developers for violating registration norms, imposing penalties on three projects across Noida and Lucknow.

Max Estate 105 and Sobha Rivana have been fined Rs 5 lakh each for failing to register with the authority before being marketed. A similar penalty has been imposed on Avikalp Estate, a project located in Lucknow.

According to UP-RERA officials, all three projects were found to be actively promoted through websites and other channels despite lacking mandatory registration. Notices were issued to the developers, but their responses failed to justify the violations.

An official stated that these actions are in clear breach of Section 3 of the Real Estate (Regulation and Development) Act, 2016, which makes it compulsory for developers to register their projects before advertising, selling, or booking units.

Under RERA guidelines, any project within a notified planning area must be registered if it exceeds 500 square metres of land or includes more than eight residential units. Promoting or selling such projects without registration is treated as a punishable offence.

UP-RERA has reiterated that strict penalties will continue for non-compliance. Under Section 59 of the Act, developers can face fines of up to 10% of the total project cost. Continued violations may also lead to harsher consequences, including additional fines or even imprisonment.

UP-RERA Chairman Sanjay Bhoosreddy emphasized that the authority will not tolerate such violations. He stated that promoting or selling unregistered projects is a serious offence and assured that strict enforcement actions will continue to protect homebuyers.

This action serves as a reminder for buyers to verify whether a project is registered with RERA before investing. Registration ensures transparency, legal protection, and accountability from developers, reducing the risk of fraud or project delays.
