DTCP Serves Notice After Sector 65 Commercial Project Licence Lapses

Haryana’s town planning department has served a regulatory notice to a developer in Gurugram after licences for a Sector 65 commercial project expired years ago, citing multiple compliance failures under state planning laws.

Gurugram: The Directorate of Town and Country Planning (DTCP), Haryana, has issued a regulatory notice to a developer over alleged non-compliance related to a commercial colony project in Sector 65, Gurugram, after the project’s licences lapsed several years ago.

According to officials, the developer was granted licences in 2011 and 2012 for a commercial project spread across nearly 3.2 acres in the revenue estate of Badshapur, falling under the Gurgaon–Manesar Urban Complex. However, these approvals expired in January 2019 and February 2020 and were never renewed.

DTCP stated that the developer failed to apply for licence renewal within the prescribed timeline and did not submit the required renewal fees or supporting documents. In addition, the department pointed out that land earmarked for master plan roads was not transferred to the government free of cost, a mandatory requirement under the Haryana Development and Regulation of Urban Areas Act, 1975.

The notice further noted that these shortcomings amount to violations of the Act, relevant Rules, and agreements executed with the department. Authorities warned that such lapses could render the licences null and void.

To resolve the matter, DTCP has granted the developer 30 days to address and rectify the deficiencies. Failure to comply may invite further action under Rule 18(2) of the Haryana Development and Regulation of Urban Areas Rules, 1976.

Enforcement officials have also been instructed to initiate proceedings under Section 10 of the Act and submit a detailed report within ten days. In the interest of transparency, DTCP has directed that the case status be uploaded on the department’s official website for public viewing.

Officials said the move is part of ongoing efforts to ensure stricter compliance in Gurugram’s rapidly expanding real estate sector, particularly for commercial developments, where regulatory adherence plays a key role in safeguarding buyer interests and planned urban growth.
